Terms of Use

Please read these terms before using temisansagay.com. The site takes your name and email address so the author can tell you when The Second Immigration is available and when there is an event near you. Using the site means you accept the terms on this page.

1Accepting these terms

These terms are an agreement between you and Temisan Sagay. They govern your access to and use of temisansagay.com, including its content and the waitlist form, and they include the Privacy Policy, which is part of them by reference. Visiting the site, joining the waitlist, or writing to the address below means you accept them. If you do not accept them, please do not use the site.

2Who runs this site

The site is operated by Temisan Sagay, of Ontario, Canada, reachable at connect@temisansagay.com.

3Who may use it

The site is offered to people aged 18 or over. Using it means you confirm that you are at least 18, that you are able to enter a binding agreement, and that the email address you enter is yours to use. If you do not meet those conditions, please do not use the site.

4Changes to these terms

These terms may be revised at any time. A revision takes effect when it appears on this page, and it applies to any use of the site after that. The current version will always carry the date it took effect at the top, so checking this page when you return is worth a moment. Continuing to use the site after a revision is posted means you accept it.

One exception: a change to section 23 or section 24, which deal with disputes and governing law, will not apply to a dispute that either of us already knew about on the day the change was posted.

5Access to the site

The site, and anything offered on it, may be withdrawn or amended at any time without notice, and no liability arises where all or part of the site is unavailable for any period. Making the arrangements you need in order to reach the site is your responsibility, as is making sure that anyone who uses your internet connection to reach it understands these terms.

There are no user accounts on this site, and no password is ever needed. Should an account area be added later, terms covering it will be published before it opens.

6What the waitlist is, and is not

7The email you agree to receive

Submitting the form is your express consent to receive email about this book and its events. Every message will identify the sender, will carry a mailing address as Canadian anti-spam law requires, and will offer a way to leave the list. A reply asking to come off is honoured just as quickly. How your details are handled is set out in the Privacy Policy.

Messages go out when there is something worth saying rather than on a schedule, and no attempt will be made to move you onto an unrelated list without asking you first.

8Give real details

Enter your own name and your own email address, and keep them accurate. Submitting somebody else's address, or automating submissions, is not permitted, and any entry that appears to be false or automated may be removed without notice.

9Buying the book

Nothing is sold on this site today. When the book becomes available, links may point to a bookseller or a retailer, and any purchase you make there is a contract between you and that seller, on their terms, with their prices, delivery and returns. Should selling ever happen directly from this site, additional terms covering payment, delivery and refunds will be published first.

10Reliance on what is published here

Everything on this site is offered for general information. No warranty is given that it is accurate, complete or useful, and any reliance you place on it is at your own risk. Where the site carries a quotation, a review, an endorsement or any other material from somebody other than the author, the views in it belong to whoever wrote it and no responsibility is taken for its accuracy.

11Anything you send the author

The site has no comment area, forum or upload feature. You are welcome to write by email, and please understand what that means:

Should a personal story ever be quoted publicly, that would only happen with your permission asked for and given first.

12What belongs to whom

The text of this site, the title The Second Immigration, the series name The Japa Diary, and the cover artwork including its lettering are the property of the author or the author's licensors, protected by copyright, trademark and other laws. Names, logos and marks used on this site are those of their respective owners.

You may use this site for your own personal, non-commercial purposes. You may link to it freely, and you may share a screenshot of the cover when talking about the book, and you may quote a short passage in a review with the source named. Reproducing the cover artwork, altering it, republishing the text of the site, creating derivative works, or using any of this material commercially requires written permission.

Where material is copied in breach of this section, the right to use the site ends immediately, and any copies made must be destroyed or returned on request. No right or title in the site or its content passes to you, and every right not expressly granted here is reserved.

13Prohibited uses

Use the site lawfully and in line with these terms. Please do not:

14Monitoring, enforcement and removal

Where these terms are broken, the author may remove an entry from the list, refuse further access to the site, take any step considered necessary or appropriate, cooperate fully with a law enforcement authority or a court order, and take legal action over illegal or unauthorised use. Where a third party claims that material you sent infringes their rights, your identity and the relevant details may be disclosed to them.

No claim arises against the author out of an action taken during, or as a result of, an investigation by the author or by a law enforcement authority into a suspected breach of these terms.

15If you think something here infringes your rights

Write to connect@temisansagay.com with enough detail to identify the material and the right you rely on. A genuine complaint will be looked at promptly and the material removed where the complaint is well founded.

16Events

An invitation to a reading, signing or launch is an invitation, not a ticket. Dates, venues, capacity and the author's attendance may all change or be cancelled, and any venue you attend has its own rules and its own terms. Travel and other costs you incur in order to attend are your own.

17Links out

Where this site links to a retailer, a venue, a publisher or another third party, that destination has its own terms and its own privacy practices, and the author does not control them. A link is not an endorsement.

18No professional advice

Nothing on this site is professional, medical, psychological, legal or financial advice, and any book referred to here is a work of reflection and opinion rather than a substitute for professional support. If you are struggling with burnout or with your mental health, please speak to a qualified professional or contact a local support service.

19The site is provided as it is

To the fullest extent the law allows, this site and its content are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied. No representation is made that the site will be accurate, reliable, complete, secure, uninterrupted or free of error, that defects will be corrected, or that the site or its server is free of viruses or other harmful components. Warranties of merchantability, fitness for a particular purpose and non-infringement are disclaimed to the extent the law allows.

Keeping your own device protected, including antivirus measures, is your responsibility. This section does not affect any warranty that cannot lawfully be excluded.

20Limits of responsibility

To the fullest extent the law allows, the author is not liable for any loss or damage arising from your use of this site or from reliance on anything published on it, including lost profit, lost data, business interruption, or any indirect, incidental or consequential loss, and including loss caused by a denial of service attack, a virus, or other harmful material acquired through use of the site or of any site linked from it.

Where liability cannot be excluded, the total liability of the author for any claim connected with this site is limited to the greater of CAD $100 or the amount you have paid in connection with the matter complained of, which for a free waitlist is nothing.

These limits do not apply to liability for fraud, for gross negligence or wilful misconduct, for death or personal injury caused by negligence, or to anything else that cannot lawfully be limited. Nothing in these terms removes a right you hold under applicable consumer protection law.

21Where these limits may not apply

Some jurisdictions do not permit the exclusion of certain warranties or the limitation of liability for incidental or consequential loss, so parts of sections 19 and 20 may not apply to you. Everything else in these terms continues to apply.

22If your use causes a claim

Should a third party bring a claim arising from your misuse of this site, your breach of these terms, or your use of information obtained from the site, you agree to defend and indemnify the author against that claim and to cover the reasonable costs of dealing with it, including reasonable legal fees.

23Resolving a dispute

Should something go wrong, please write to connect@temisansagay.com first and allow 30 days to resolve it directly. Most problems end there. If a dispute remains after that, either of us may take it to the courts identified in section 24. Nothing in this section prevents either of us from seeking urgent relief from a court where that is genuinely needed.

24Governing law and jurisdiction

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules. Any proceeding arising out of these terms or the site is to be brought in the courts of Ontario, and you accept the jurisdiction of those courts. Where you have broken these terms, the author also keeps the right to bring proceedings in your country of residence or any other relevant country.

25If part of these terms cannot apply

Should any part of these terms be found invalid or unenforceable, the rest continues to apply. A delay or failure in enforcing a term is not a waiver of it. These terms may not be assigned by you without permission, and may be assigned by the author to anyone who takes over the book, the series or this site. These terms, together with the Privacy Policy, are the entire agreement between you and the author about this site, and they replace anything said or written about it beforehand.

These terms are written in English, and the English version governs. Any translation offered is for convenience only.
